EU KNOW-HOW TRANSFER

Alongside the transfer or licensing of intellectual property rights, the transfer of know-how is a very important part of technology transfer. This is true at least if technology transfer is defined as the transfer and economic utilization of scientific knowledge from one company to another. The knowledge to be transferred can be of a technical, commercial or business nature. These can allow or enable the know-how recipient to carry out its operational activities, especially its production.

Technology transfer agreements are subject to an extensive set of rules of EU and German law. Particular attention must be paid to German and EU antitrust regulations. Otherwise, the agreement may become invalid and fines may be imposed.
